Beta Privacy Notice

"Personal information" means information relating to an identified or identifiable individual.

"Special category data" includes health-related information you voluntarily provide about injuries, conditions, pain, surgeries, or training limitations relevant to safe exercise adaptation.

"Movement data" means data derived from workout recordings, including biomechanical signals, pose estimates, metrics, labels, and associated metadata.

"Cohort" means a limited group of selected participants in a defined three-month beta period.

Depending on your stage of involvement, we may process:

• Application and profile data: name, email, gender, training experience, frequency, motivation, readiness responses, and consent records
• Health-related data you choose to disclose for safe program adaptation
• Workout recordings and movement data captured as part of the Beta Program
• Coach notes, feedback, check-in records, and communications with the beta team
• App usage, diagnostics, crash logs, feature interaction, and performance data
• Technical identifiers necessary to secure accounts and the beta environment

We process beta information to:

• Evaluate applications and administer cohort selection
• Design, deliver, and adapt your personalized three-month training program
• Provide professional coach supervision, technique feedback, and participant support
• Operate, test, debug, and improve the Oh My Perfect Form application
• Train, validate, and refine movement recognition algorithms and neural network models
• Improve accuracy, safety, usability, and quality of coaching features
• Conduct internal research and product development in real training conditions
• Communicate about onboarding, scheduling, safety, and program updates
• Maintain records of consent, compliance, and incident response
• Protect against misuse, fraud, and security threats

Where GDPR or equivalent laws apply, we rely on explicit consent for special category health data, workout recordings, movement data used for research and model training, and optional marketing communications.

We rely on contractual necessity and legitimate interests for cohort administration, coach supervision, service delivery, security, and proportionate product improvement, where permitted by law and balanced against your rights.

We rely on legal obligation where processing is required to comply with applicable law.

The product may use automated systems to analyze movement and suggest technique feedback. Automated outputs during beta are subject to human review by coaches where applicable and are not used as sole basis for medical decisions. Cohort selection involves human review; we do not make solely automated decisions about admission.

We do not sell personal information. Access is limited to personnel and contractors with a need to know, including coaches, product engineers, and support staff bound by confidentiality obligations.

We use infrastructure and service providers (such as cloud hosting, email, and database services) as processors under written agreements requiring appropriate security and confidentiality.

Information may be processed in Ukraine and other countries where we or our processors operate. Where required, we implement safeguards such as standard contractual clauses or equivalent transfer mechanisms.

Application data is retained while needed for selection, waitlist management, and recordkeeping of consent, typically up to twenty-four (24) months unless a longer period is required by law or active participation continues.

Participation data, including recordings and movement data, is retained for the cohort period and thereafter for product improvement, model evaluation, legal compliance, and dispute resolution for a period proportionate to the purpose, generally not exceeding thirty-six (36) months from cohort end unless you withdraw consent or deletion is required by law.

We may retain anonymized or aggregated data that no longer identifies you for research and statistical purposes.

We apply access controls, encryption in transit where supported, environment segregation for beta systems, logging, and staff training. You are responsible for safeguarding your account credentials and device access.

Subject to applicable law, you may request access, correction, deletion, restriction, objection, or portability, and may withdraw consent for consent-based processing.

Withdrawal of consent may affect our ability to continue your participation where processing is essential to the Beta Program. Contact info@ohmyperfectform.com to exercise rights. You may lodge a complaint with a supervisory authority.

The Beta Program is limited to adults aged 18 and over. We do not knowingly process minors' information.

We may update this Notice as the Beta Program evolves. Material changes will be communicated to active participants and posted with an updated effective date.
