Beta Participation Agreement

The Beta Program is a three (3) month research collaboration in which selected participants receive, at no charge for the cohort period: (a) a personalized training program; (b) access to the Oh My Perfect Form beta application; and (c) professional coach supervision and check-ins.

The purpose is to evaluate movement coaching technology in real training conditions and improve product performance, safety, and user experience.

You represent that you are at least eighteen (18) years old, legally able to enter this Agreement, and physically able to engage in exercise-based training subject to coach review of information you provide.

Selection is by invitation only. Application does not guarantee admission. We may decline or revoke participation at our discretion for safety, compliance, or program integrity reasons.

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the beta application and program materials solely for participation in your assigned cohort.

You may not sublicense, reverse engineer, copy, distribute, or commercialize beta software or unreleased features except as expressly permitted in writing.

You agree to:

• Follow your personalized program in good faith and use the app as instructed
• Complete requested workout recordings and check-ins accurately and on schedule
• Provide honest feedback about product performance and coaching experience
• Disclose relevant health or injury information truthfully for safe adaptation
• Maintain confidentiality of unreleased features, credentials, and non-public program details
• Treat coaches, staff, and other participants with respect
• Comply with the Beta Privacy Notice, Data Consent, and reasonable safety instructions

You authorize collection and use of workout recordings and movement data as described in the Data Consent and Beta Privacy Notice, including use for algorithm and neural network training and product improvement.

You agree to record only exercises and setups requested by the program team and not to include bystanders or unrelated private spaces without lawful authority.

Coach supervision is provided for fitness coaching and beta testing purposes only. It is not medical care, physical therapy, diagnosis, prescription, emergency response, or a substitute for consultation with a qualified healthcare professional.

Oh My Perfect Form is not a certified medical device during this beta stage. You remain solely responsible for training decisions and for stopping activity and seeking medical attention if you experience pain, dizziness, shortness of breath, or other concerning symptoms.

Physical exercise involves inherent risks. You voluntarily assume risks associated with training and beta technology use, except to the extent caused by our gross negligence or willful misconduct where such limitation is prohibited by law.

Selected participants are not charged program fees for the cohort period unless otherwise agreed in writing. We may modify future commercial terms outside this beta cohort separately.

Bezryma Group owns all rights in the Oh My Perfect Form platform, algorithms, models, training content, and related intellectual property.

You retain ownership of your personal recordings to the extent provided by law, while granting us the licenses necessary to operate the Beta Program as described in the Data Consent.

Suggestions, bug reports, and feedback you provide may be used by us without restriction or compensation for product development, unless otherwise agreed in writing.

Beta features, performance, unreleased interfaces, and internal processes are confidential. You may not publish reviews, screenshots, or performance benchmarks without our prior written approval, except disclosures required by law.

This Agreement begins upon onboarding and continues through your cohort period unless terminated earlier.

You may withdraw by notifying info@ohmyperfectform.com. We may suspend or terminate participation immediately for breach, safety concerns, misuse, harassment, or conduct harmful to the program.

Sections intended to survive termination, including intellectual property, confidentiality, disclaimers, and limitation of liability, shall survive.

THE BETA APPLICATION, COACHING SUPPORT, AND PROGRAM MATERIALS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BEZRYMA GROUP LLC SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF DATA, PROFITS, OR GOODWILL ARISING FROM BETA PARTICIPATION.

OUR AGGREGATE LIABILITY UNDER THIS AGREEMENT SHALL NOT EXCEED ONE HUNDRED US DOLLARS (USD $100) OR THE MINIMUM AMOUNT REQUIRED BY APPLICABLE LAW.

You agree to indemnify Bezryma Group against claims arising from your breach of this Agreement, negligent or unlawful conduct during participation, or violation of third-party rights, except to the extent caused by our gross negligence or willful misconduct.

This Agreement is governed by the laws of Ukraine. Subject to mandatory consumer protections, courts in Kyiv, Ukraine shall have exclusive jurisdiction unless otherwise required by law.

This Agreement, together with the Beta Privacy Notice, Data Consent, and onboarding materials, constitutes the entire agreement regarding beta participation. We may update program policies with notice to active participants where required.
